Good To Know
- Potential penalties total $35 million, subject to conditions.
- Mashinsky is serving a 12 year federal prison sentence.
Two Conditions Determine The Payments
The former Celsius Network LLC CEO must pay New York $25 million if he fails to forfeit another $10 million to the federal government. A separate $10 million payment applies if he does not serve his full sentence.
Meanwhile, Celsius bankruptcy distributions exceeded $3.4 billion by August 2026.
Attorney General Letitia James sued Mashinsky in 2023 over fraud affecting hundreds of thousands of investors, including more than 26,000 New Yorkers. He promoted low risk investments while hiding losses. Celsius also lacked the strict regulatory requirements that applied to banks.
