UAE Exempts Crypto Transactions from VAT, Aligning with Financial Services

Value-added tax (VAT) on cryptocurrency transactions has been formally eliminated by the United Arab Emirates (UAE), signaling a dramatic change in the country’s attitude toward digital assets. This new restriction goes into effect retroactively on November 15, 2024, with transactions made before January 1, 2018, being excluded. The modification aligns the treatment of digital assets with the UAE’s taxation of traditional financial services.

Tax Exemption Clarified for Digital Assets

The UAE’s Federal Tax Authority (FTA) first shared the Arabic version of this update on October 2, 2024, followed by an English translation two days later. This is the first time it has been clearly stated that VAT will not be applied to digital assets. The exemption covers not only the exchange of cryptocurrencies but also the transfer of ownership. Consequently, all crypto transfers and conversions will now avoid the usual 5% VAT.

This decision is seen as a move to clarify the legal standing of virtual assets in the country. Ankita Dhawan, a senior associate at the Métis Institute, emphasized the importance of the change, stating, “The UAE has essentially classified virtual assets in the same bucket as traditional financial services – several of which are already exempt from VAT. This legitimizes VAs.”

By classifying virtual assets in the same way as conventional financial services, the United Arab Emirates is strengthening its standing as a hub that welcomes cryptocurrencies. Because the exemption eliminates a substantial expense related to digital transactions, it may draw in more companies and investors to the country. This is consistent with the UAE’s overarching plan to promote fintech and blockchain technology innovation.
