Ron Wyden (D-OR), Sen. Mike Crapo (R-ID), Rep. Richard Neal (D-MA), and Rep. Kevin Brady (R-TX) Tuesday, James wrote:<\/p>\n<blockquote>\n<p>On behalf of the people of the state of New York, I urge Congress to pass legislation to designate digital assets \u2014 e.g., cryptocurrencies, digital coins, and digital tokens \u2014 as assets that cannot be purchased using funds in Individual Retirement Accounts (IRAs) and defined contribution plans, such as 401(k) and 457 plans.<\/p>\n<\/blockquote>\n<p>James provided a few reasons why cryptocurrencies are too risky to be allowed in retirement plans. In addition to having no intrinsic value, she said they are extremely volatile and \u201coften an instrument for fraud and crime.\u201d<\/p>\n<p>The attorney general also referenced the terra crash and FTX meltdown, both of which were followed by crypto market sell-offs. Crypto exchange FTX filed for <a href=\"https:\/\/news.bitcoin.com\/troubled-crypto-exchange-ftx-files-for-chapter-11-bankruptcy-protection-ceo-steps-down\/\">bankruptcy<\/a> on Nov. 11 amid <a href=\"https:\/\/news.bitcoin.com\/sec-doj-investigate-ftx-regulators-suspect-crypto-exchange-mishandles-customer-funds\/\">investigations<\/a> that it mishandled customer funds.<\/p>\n<p>Citing \u201crecent crypto market crashes and other market turbulence,\u201d Attorney General James said:<\/p>\n<blockquote>\n<p>Investing Americans\u2019 hard-earned retirement funds in crashing cryptocurrencies could wipe away a lifetime\u2019s worth of hard work.<\/p>\n<\/blockquote>\n<p>\u201cOver and over again, we have seen the dangers and pitfalls of cryptocurrencies and the wild swings in these funds. Hardworking Americans should not have to worry about their retirement savings being wiped out due to risky bets on unstable assets like cryptocurrencies,\u201d the attorney general stressed.<\/p>\n<p>James also wants lawmakers to reject two bills that would allow crypto investments in retirement accounts. She wrote:<\/p>\n<blockquote>\n<p>I urge Congress to reject the recently proposed Retirement Savings Modernization Act \u2026 and the Financial Freedom Act of 2022.<\/p>\n<\/blockquote>\n<p>The <a href=\"https:\/\/news.bitcoin.com\/us-lawmakers-introduce-bill-allowing-crypto-investments-in-401k-retirement-plans\/\">Retirement Savings Modernization Act<\/a> would \u201cexpressly allow 401(k) plan fiduciaries to make digital assets an investment option,\u201d James explained.<\/p>\n<p>The <a href=\"https:\/\/news.bitcoin.com\/us-senator-introduces-bill-prohibiting-labor-department-from-interfering-with-crypto-in-retirement-accounts\/\">Financial Freedom Act of 2022<\/a> would \u201cprohibit the Secretary of Labor from constraining or prohibiting the range of investments offered through a self-directed brokerage window, i.e., the Secretary of Labor would not be able to prohibit investments in digital assets,\u201d the NY attorney general emphasized.<\/p>\n<p>Fidelity Investments, the largest 401(k) administrator by assets, began offering bitcoin investments in retirement accounts this fall. This has <a href=\"https:\/\/news.bitcoin.com\/fidelitys-bitcoin-401k-offering-risks-retirement-security-of-americans-says-labor-department-official\/\">troubled<\/a> the U.S. Department of Labor. Treasury Secretary Janet Yellen has also <a href=\"https:\/\/news.bitcoin.com\/us-treasury-secretary-yellen-warns-crypto-is-very-risky-unsuitable-for-most-retirement-savers\/\" target=\"_self\" rel=\"noopener\">warned<\/a> that crypto is \u201cvery risky,\u201d noting that it is unsuitable for most retirement savers. This week, three U.S. senators sent a <a href=\"https:\/\/news.bitcoin.com\/us-senators-urge-fidelity-to-stop-offering-bitcoin-in-401k-plans-citing-ftx-collapse-serious-problems-in-crypto-industry\/\">letter<\/a> to Fidelity CEO Abigail Johnson, urging her firm to stop offering bitcoin as an option for retirement accounts.<\/p>\n<p><em><strong>What do you think about New York Attorney General Letitia James urging Congress to prohibit crypto investments in retirement accounts?
