According to court documents in the FTX bankruptcy case, the company\u2019s attorneys seek to subpoena FTX co-founder Sam Bankman-Fried, his brother Gabriel Bankman-Fried, and his parents, Joseph Bankman and Barbara Fried. Additionally, the attorneys intend to question some of Bankman-Fried\u2019s top deputies, including FTX co-founder Gary Wang, ex-Alameda Research CEO Caroline Ellison, the former chief operating officer Constance Wang, and the exchange\u2019s former director of engineering Nishad Singh.<\/strong><\/p>\n

FTX Attorneys Push for Subpoena of Co-Founder, Associates, Parents, and Brother<\/h2>\n

Lawyers for FTX Trading Ltd. and the bankruptcy case<\/a>\u2018s official creditors committee filed a motion that aims to question Sam Bankman-Fried (SBF)<\/a>, his parents, his brother, and a few of the former CEO\u2019s top lieutenants. The lawyers contend that specific insiders associated with Bankman-Fried\u2019s dealings could provide much-needed insight into financial matters.<\/p>\n

\u201cCertain insiders are currently cooperating with the debtors to provide important information. But others are not, and thus authorization to issue subpoenas to those with the missing information is critical to the debtors\u2019 and committee\u2019s recovery efforts,\u201d the joint motion details.<\/p>\n

The current FTX CEO<\/a>, John J. Ray III, told<\/a> Congress that Joseph Bankman and \u201cthe family certainly received payments\u201d from FTX. Bankman and Barbara Fried have not been charged with any wrongdoing, but the recent court filing claims they both had associations with the firm. The filing alleges that Fried\u2019s political action committee (PAC) Mind the Gap received funds from FTX. Barbara Fried \u201chas ignored the requests altogether,\u201d the joint motion discloses. Bankman allegedly gave tax advice to staff and was involved in linking FTX with the company\u2019s first litigation firm, the court filing explains.<\/p>\n

\u201cThe insiders are best positioned to assist\u201d the case, FTX attorneys further insist in the latest filing. The document notes that lawyers want to question Gabriel Bankman-Fried, SBF\u2019s brother. The filing talks about Bankman-Fried\u2019s brother\u2019s nonprofit<\/a>, Guarding Against Pandemics. It mentions the alleged political lobbying<\/a> that reportedly took place near the U.S. Capitol at a \u201cmultimillion-dollar property,\u201d which \u201cthe debtors believe was purchased using misappropriated customer funds.\u201d In addition to Bankman-Fried\u2019s brother and parents, Constance Wang<\/a>, Caroline Ellison<\/a>, Gary Wang, and Nishad Singh<\/a> are mentioned in the request.<\/p>\n

The U.S. Bankruptcy Court for the District of Delaware judge, John Dorsey, must approve the request to subpoena SBF and the members of his inner circle. Bankman-Fried has been indicted<\/a> by a federal grand jury in Manhattan and faces charges of \u201cconspiracy to commit wire fraud, wire fraud, conspiracy to commit commodities fraud, conspiracy to commit securities fraud, conspiracy to commit money laundering, and conspiracy to defraud the Federal Election Commission and commit campaign finance violations.\u201d SBF currently awaits trial<\/a> over the charges, which is scheduled for Oct. 3, 2023.<\/p>\n

\u201cDebtors have not received meaningful engagement or any response from Singh or Mr. Gabriel Bankman-Fried,\u201d the FTX attorneys added in the filing.<\/p>\n
