The action, which was submitted to the Northern District of Texas on April 25th, charges the SEC of trying to categorize Ethereum (ETH) as a security.<\/p>\n<p>Consensys draws attention to the SEC\u2019s evolving position on Ethereum by quoting earlier remarks from 2018 that did not classify ETH as a security. Consensys is concerned about this abrupt shift in strategy because it may leave holders of Ethereum with unclear legal obligations.<\/p>\n<h2><strong>Allegations Against Consensys<\/strong><\/h2>\n<p>The filing sheds light on the SEC\u2019s scrutiny of Consensys\u2019 services, including MetaMask Swaps and Staking, alleging that the firm operates as an unregistered broker-dealer. This scrutiny follows a Wells notice issued to Consensys on April 10th, signaling potential enforcement actions.<\/p>\n<p>Consensys seeks judicial intervention to affirm that ETH is not a security and that its operations do not involve the sale of securities.
