The payouts will represent about 77% of customers\u2019 claims.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, the payout doesn\u2019t include Digital Currency Group (DCG), the parent company of Genesis Global.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The development comes after US Bankruptcy Judge Sean Lane approved the Chapter 11 bankruptcy plan Genesis Global and its subsidiaries filed in January 2023. Genesis\u2019 bankruptcy followed the <a href=\"https:\/\/coinjournal.net\/news\/what-does-three-arrows-capital-demise-mean-for-the-crypto-universe\/\">collapse of Three Arrows Capital<\/a> and <a href=\"https:\/\/coinjournal.net\/news\/this-week-in-crypto-ftx-files-for-chapter-11-bankruptcy\/\">FTX<\/a> in 2022.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Judge overrules DCG objection<\/span><\/h2>\n<p><span style=\"font-weight: 400\">As noted above, the plan to return billions of dollars worth of crypto assets and cash to Genesis creditors has received a node from Judge Sean Lane.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">On Friday, the judge overruled DCG\u2019s objection to the liquidation plan, paving way for this significant step in the right direction for creditors.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In their argument, DCG had argued that Genesis should pay customers as per the value of their crypto assets at the time the company filed for bankruptcy.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In dismissing DCG\u2019s objections, Judge Lane noted:<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201c<em>The record here clearly establishes that there is not sufficient value in the Debtors\u2019 estates to provide DCG a recovery as equity holder after unsecured creditors are paid\u2026 Given the size of the creditor claims, DCG is out of the money as an equity holder by billions of dollars, even if the Court valued creditor claims using the method DCG proposes<\/em>.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">When Genesis filed for Chapter 11, customer claims by the top 50 creditors was over $3.5 billion. The court\u2019s approval of the liquidation plan will see approximately 97% of reimbursements handled in-kind.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This means a customer who deposited BTC will receive payout in BTC and not the equivalent US dollar value.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Genesis to return crypto to customers beginning next month<\/span><\/h2>\n<p><span style=\"font-weight: 400\">At current prices, customer claims for Bitcoin or Ethereum are trading at 97-110% for claims amounting to over $10 million. Claims under $1 million are trading at 74-94%. In comparison, the claims traded at 35% at the time the crypto lender filed for bankruptcy.<\/span><\/p>\n<p><span style=\"font-weight: 400\">For stablecoins, its 89-91% for claims of $1-10 million and 73-88% for accounts with under $1 million.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The plan allows for creditors reimbursements to begin early next month, bringing value to <a href=\"https:\/\/coinjournal.net\/news\/genesis-agrees-to-21m-sec-settlement-over-gemini-earn\/\">Gemini Earn customers<\/a> and other Genesis creditors.\u00a0<\/span><\/p>\n<p>Notably, the <a href=\"https:\/\/coinjournal.net\/bitcoin\/\">price of Bitcoin<\/a> has increased significantly since January 2023, rising from around $21k to currently hover above $66k.
