Shelby ruled Tuesday that the Commodity Exchange Act does not shield Kalshi from Utah\u2019s anti-gambling laws, granting the state summary judgment and denying the exchange\u2019s motion for a preliminary injunction. \u201cThe court concludes the federal law relied upon by Kalshi does not preempt Utah\u2019s ability to enforce its anti-gambling laws,\u201d Shelby wrote.<\/p>\n<p>The reasoning turned on ambiguity rather than a finding that event contracts are gambling. Shelby held that the CEA\u2019s jurisdictional provisions admit multiple plausible readings, and that courts normally disfavor preemption in exactly that situation. \u201cGiven the [Commodity Exchange Act\u2019s] framework and the history of State regulation of gambling, the court cannot conclude the CEA is so pervasive that there is no room for the State of Utah to supplement it,\u201d he wrote, in a <a href=\"https:\/\/news.bloomberglaw.com\/securities-law\/utah-can-apply-anti-gambling-laws-against-kalshi-judge-rules\" target=\"_blank\" rel=\"noopener noreferrer\">decision first detailed<\/a> by Bloomberg Law.<\/p>\n<p>He also <a href=\"https:\/\/sbcamericas.com\/2026\/08\/05\/kalshi-denied-utah-injunction\" target=\"_blank\" rel=\"noopener noreferrer\">rejected Kalshi\u2019s central statutory argument<\/a>. The exchange had contended that language changes introduced by the Dodd-Frank Act established federal preemption over derivatives trading; Shelby called that an \u201cimplausible\u201d reading of congressional intent, noting that Kalshi itself concedes gambling is a field \u201ctraditionally regulated by the states.\u201d<\/p>\n<p>Utah is an unusually hostile venue for the argument. The state constitution bans gambling outright, and offering online betting there is a third-degree felony. A new state law adding proposition bets to the statutory definition of gambling prompted Kalshi to sue in February, after Gov. Spencer Cox publicly attacked prediction markets and the company grew concerned that Utah intended to bring a criminal enforcement action.<\/p>\n<p>\u201cYou can\u2019t rebrand illegal gambling as a federal commodity, and today a federal judge agreed with us,\u201d <a href=\"https:\/\/utahnewsdispatch.com\/2026\/08\/04\/kalshi-is-subject-to-utahs-anti-gambling-law-judge-rules\/\" target=\"_blank\" rel=\"noopener noreferrer\">Utah Attorney General Derek Brown said<\/a>, adding, \u201cKalshi bet that clever branding would beat Utah law. Kalshi lost and Utah won.\u201d Cox was blunter still, <a href=\"https:\/\/www.kuer.org\/politics-government\/2026-08-04\/kalshi-prediction-markets-utah-gambling-ban-ruling\" target=\"_blank\" rel=\"noopener noreferrer\">posting after the ruling<\/a> that \u201cprediction markets are gambling, full stop\u201d and that they are \u201ccausing tremendous harm to countless American families.\u201d<\/p>\n<p>Kalshi spokesperson Jacki McGavick said the company disagrees with the decision and that it will not be the final word in Utah. Sports event contracts remain available to Utah users for now, with no enforcement action filed.<\/p>\n<p>New York\u2019s attorney general submitted Shelby\u2019s decision as supplemental authority within a day, using it to oppose the CFTC\u2019s motion for a preliminary injunction against the state after it sued Kalshi as an unlicensed gambling operation last week.<\/p>\n<p>Gambling attorney Daniel Wallach, who <a href=\"https:\/\/readwrite.com\/kalshi-plans-appeal-utah-judge-backs-state\/\" target=\"_blank\" rel=\"noopener noreferrer\">flagged the New York citation<\/a>, said the expected Tenth Circuit appeal would put prediction-market cases before seven of the 13 federal appellate circuits \u2013 the First, Second, Third, Fourth, Sixth, Ninth and Tenth \u2013 with the Seventh and Eighth expected to follow. That scale of circuit activity is what typically produces a split ripe for Supreme Court review.<\/p>\n<p>A Washington state court <a href=\"https:\/\/news.bitcoin.com\/washington-judge-rejects-kalshis-federal-defense-grants-state-injunction\/\">granted an injunction<\/a> on July 20 after rejecting the same preemption defense and finding that Kalshi \u201coperates an online betting platform,\u201d and more than <a href=\"https:\/\/news.bitcoin.com\/prediction-market-fight-deepens-as-40-states-push-back-on-cftc\/\">40 states have pushed back<\/a> on the CFTC\u2019s claim to exclusive jurisdiction.
