prison.<\/span><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<h2>Hungary Decriminalizes Crypto Assets\u2019 Offenses in Line With MiCA Implementation<\/h2>\n<p>Hungary is repealing draconian-style regulations to avoid clashes with the <a href=\"https:\/\/news.bitcoin.com\/mica-deadline-hits-july-1-as-unlicensed-crypto-platforms-face-eu-shutdown-risk\/\">EU-wide Markets in Crypto Assets (MiCA) framework<\/a>, dropping national requirements and offenses related to the illicit use of cryptocurrency.<\/p>\n<p>The Hungarian Parliament recently passed Act XXXVIII of 2026 on the Repeal of Certain Statutory Provisions Concerning Crypto-Asset Conversion Services, which abolished the validation checks that any European exchange had to pass to operate legally on Hungarian soil.<\/p>\n<p>According to Andr\u00e1s Ga\u00e1l, an associate at Schonherr, a law firm, under previous rules, converting crypto assets without prior validation <a href=\"https:\/\/www.schoenherr.eu\/content\/hungary-scraps-its-separate-national-crypto-conversion-validation-regime\" target=\"_blank\" rel=\"noopener noreferrer\">constituted an unauthorized crypto transaction<\/a>, a crime typified in the<a href=\"https:\/\/njt.jog.gov.hu\/jogszabaly\/en\/2012-100-00-00\" target=\"_blank\" rel=\"noopener noreferrer\"> Act C of 2012 on the Criminal Code<\/a>.<\/p>\n<p>The repeal, voted on July 31 and implemented on August 7, was unique to Hungary and established two crimes for the unauthorized use of crypto assets:<\/p>\n<p>The first<strong>, \u201cAbuse of crypto assets,\u201d<\/strong> established that <strong>\u201ca person who exchanges crypto-assets of significant value for money or other crypto-assets using an unauthorised crypto-asset exchange service is guilty of a misdemeanour and shall be punished by imprisonment of up to two years, unless a criminal offence of greater gravity is established,\u201d<\/strong> but increased the penaltiesto to 5 years if the offense was committed committed<strong> \u201cfor a particularly significant value.\u201d<\/strong><\/p>\n<p>The second offense repealed was <strong>\u201cUnauthorized crypto-asset exchange service provision,\u201d <\/strong>which established that <strong>\u201ca person who engages in crypto-asset exchange service activities for a significant value in violation of a validation obligation under the Act on the market of cryptoassets is guilty of a felony and shall be punishable by imprisonment for up to three years,\u201d <\/strong>and increased imprisonment to eight years under certain circumstances.<\/p>\n<p>Katalin Horv\u00e1th, partner at CMS Budapest, stressed that the<a href=\"https:\/\/cms.law\/en\/hun\/legal-updates\/hungary-repeals-crypto-asset-conversion-validation-regime\" target=\"_blank\" rel=\"noopener noreferrer\"> Act was incompatible with the EU\u2019s internal market<\/a> and was redundant with MiCA provisions, which ensure that users can access safe crypto service providers and <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/trm-labs-reveals-mica-purged-80-of-european-crypto-firms\/\">entered into full implementation on July 1<\/a>.<\/p>\n<p><strong>\u201cPayment institutions, crypto-asset service providers and intermediaries that have in-scope conversions routed to authorised validators should now unwind those processes,\u201d<\/strong> she
