The filing is labeled \u201ceconomically significant,\u201d and the SEC is zeroing in on publishing the proposed rule in October. As of today, the unpublished draft can be revised during the OIRA review process.<\/p>\n<p>Going forward, the SEC would need a commissioner\u2019s vote and collect public comments. Current TradFi rules muddled with <a href=\"https:\/\/markets.bitcoin.com\" target=\"_blank\" rel=\"noopener noreferrer\">today\u2019s crypto asset economy<\/a> have left lawyers, advisors, and companies with questions on what a qualified custodian is when it applies to blockchain assets.<\/p>\n<h2>Atkins Scraps Gensler\u2019s Approach as SEC Charts a New Course<\/h2>\n<p>The latest draft is quite different from <a href=\"https:\/\/news.bitcoin.com\/erased-gensler-texts-ignite-crypto-backlash-as-sec-watchdog-faults-avoidable-errors\/\">former SEC Chair Gary Gensler\u2019s<\/a> 2023 rules that never actually became finalized. Gensler\u2019s plan was essentially an extension of existing custody requirements and aimed to bring blockchain assets under the same umbrella. Under Chair Paul Atkins, the SEC formally withdrew Gensler\u2019s proposal and the regulator noted that a new proposal was needed. The latest proposal has a \u201cderegulatory\u201d designation, but it is not yet public what changes these will bring.<\/p>\n<h2>Self-Custody, Staking, and DeFi Could Face New Rules<\/h2>\n<p>If the proposal goes forward, it could change how advisors and custodians handle self-custody, multi-signature arrangements, staking, lending, and <a href=\"https:\/\/news.bitcoin.com\/unlocking-the-future-your-fun-guide-to-decentralized-finance-and-web3\/\">other decentralized finance (DeFi) activities<\/a>. The SEC and the OIRA may also reveal how independent verification for blockchain projects would work, and things like surprise examinations. What happens next will entirely depend on the OIRA and White House review.
