She <a href=\"https:\/\/www.reuters.com\/world\/us-judge-rules-pentagon-blacklisting-anthropic-unlawful-2026-08-28\/?taid=6a910a242c351600015c133b&amp;utm_campaign=trueAnthem:+Trending+Content&amp;utm_medium=trueAnthem&amp;utm_source=twitter\" target=\"_blank\" rel=\"noopener noreferrer\">added<\/a>:<\/p>\n<blockquote>\n<p>\u201cThe undisputed \u200brecord shows that \u200bthe challenged actions constituted \u2060unlawful retaliation in \u200bviolation of the \u200bFirst Amendment, and that Anthropic was denied the pre-deprivation \u200bprocess required under \u200bthe Fifth Amendment.\u201d<\/p>\n<\/blockquote>\n<p>Elsewhere in the order, Lin wrote that the empty invocation of national security is not a blank check to punish and retaliate against government critics, language that will likely echo through the company\u2019s other pending case.<\/p>\n<h2>How Anthropic Ended up on the Blacklist<\/h2>\n<p>The dispute traces back to February 2026, when Defense Secretary Pete Hegseth designated Anthropic a supply chain risk after the company declined to strip safety guardrails that stop its Claude models from being used for mass surveillance or fully autonomous weapons.<\/p>\n<p>The standoff was unusual because Claude had reportedly been the only AI system with access to classified Pentagon systems, and had reportedly been used in the operation that led to Nicolas <a href=\"https:\/\/news.bitcoin.com\/anthropic-faces-trumps-wrath-all-federal-agencies-to-cease-claudes-use\/\">Maduro\u2019s capture<\/a> in January 2026.<\/p>\n<p>Days later, Trump escalated the fight in a Truth Social post, warning Anthropic better get its act together or he would use the full power of the presidency to make the company comply, and ordering every federal agency to stop using its technology within a six-month phase-out window.<\/p>\n<h2>One Case Down, One Still Open<\/h2>\n<p>Thursday\u2019s order is not Anthropic\u2019s first win in this fight as <a href=\"https:\/\/news.bitcoin.com\/federal-judge-blocks-pentagon-from-labeling-anthropic-a-national-security-threat\/\">Lin first blocked<\/a> the Pentagon and 17 other federal agencies from enforcing the designation with a preliminary injunction back in March, restoring the company\u2019s existing federal contracts while the case played out. That earlier order was stayed for seven days to let the administration pursue an emergency appeal to the Ninth Circuit, and the case then moved through <a href=\"https:\/\/news.bitcoin.com\/federal-judges-deny-anthropic-relief-in-claude-military-ai-ban-set-may-oral-arguments\/\">May oral arguments<\/a> before this week\u2019s permanent ruling.<\/p>\n<p>That said, the company still isn\u2019t fully clear, and a narrower Anthropic appeal over separate Pentagon rules is still pending before the U.S. Court of Appeals for the D.C. Circuit.<\/p>\n<h2>Even Trump Backed off Months Ago<\/h2>\n<p>In a June interview with Axios, Trump said he <a href=\"https:\/\/www.axios.com\/2026\/06\/19\/trump-anthropic-national-security-the-axios-show\" target=\"_blank\" rel=\"noopener noreferrer\">no longer viewed Anthropic as a threat<\/a>, telling the outlet \u201cwell, not now, but a week ago, maybe,\u201d and crediting the company for behaving responsibly around export controls on its Fable 5 and Mythos 5 models.
