Congress is entering a post-CLARITY era.<\/p>\n<\/blockquote>\n<p>He paired the bill\u2019s stall with the Ninth Circuit\u2019s ruling against prediction markets like Kalshi and New Jersey\u2019s push to take that fight to the Supreme Court. The verdict was starker than anything the industry\u2019s own advocates have said in public, with Bitwise\u2019s Matt Hougan calling the bill \u201c<a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/clarity-act-enters-walking-dead-state-as-sec-prepares-crypto-rules\/\">walking dead<\/a>\u201d in August.<\/p>\n<h2>What Lummis Is Counting<\/h2>\n<p>Lummis answered subsequently, with <a href=\"https:\/\/x.com\/SenLummis\/status\/2096644344795246746\" target=\"_blank\" rel=\"noopener noreferrer\">the Wyoming Republican taking to X to post<\/a>:<\/p>\n<blockquote>\n<p>If the Clarity Act doesn\u2019t pass this Congress, the next real opportunity to bring market structure legislation back up is 2030. That\u2019s years of jobs, investment, and tax revenue we can avoid squandering if we finish this now.<\/p>\n<\/blockquote>\n<p>The 2030 date is not new, as she has <a href=\"https:\/\/news.bitcoin.com\/clarity-act-may-be-congress-last-chance-for-digital-asset-law-before-2030-senator-warns\/\">brought up the date many times<\/a> over the past half a year. What is, however, new is the calendar. House leaders cut eight voting days from September, and the chamber leaves Washington on Sept. 17, two days after the Senate vote, not returning until after the Nov. 3 midterms.<\/p>\n<p>If the Senate passes an amended bill, the House has 48 hours to act on it. Anything after that waits for a new Congress, then a presidential cycle.<\/p>\n<p>The negotiating room emptied a month ago. Sen. Bernie Moreno declared the talks \u201c<a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/moreno-signals-end-to-clarity-act-talks-ahead-of-cloture-vote\/\">officially ended<\/a>\u201d on Aug. 8 and said there was \u201cabsolutely nothing to iron out.\u201d The White House\u2019s Patrick Witt <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/white-house-clarity-act-september-15-deadline\/\">set the deadline<\/a> three days later, adding:<\/p>\n<blockquote>\n<p>If they can\u2019t get there by September 15, they never will.<\/p>\n<\/blockquote>\n<h2>Markets React<\/h2>\n<p>Polymarket\u2019s contract on the CLARITY Act becoming law in 2026 has traded between 13% and 18% over the past week, down from 82% in February, on more than $11.5 million of volume. Kalshi\u2019s market on whether more than 58 senators vote yes sits at 19%. Ian Katz of Capital Alpha Partners <a href=\"https:\/\/news.bitcoin.com\/featured\/clarity-act-odds-stay-buried-as-senate-showdown-closes-in\/\">cut his enactment estimate<\/a> from about 40% to 25% at the end of August, and Galaxy Research has it at 10%.<\/p>\n<p><\/p>\n<p>Traders are not doubting that a vote happens (given Kalshi priced a Senate vote before Oct. 1 at 91%), they are doubting that anything follows it.<\/p>\n<p>Lastly, <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/clarity-act-vote-is-set-for-sept-15-heres-what-happens-next\/\">the vote on Sept. 15 <\/a>is a cloture motion on the motion to proceed. It needs 60 votes. Republicans hold 53 seats, and leadership has said it expects all of them, though Sens. Josh Hawley and Jerry Moran have raised community-banking objections.
