In plain English, at least seven Democrats must join them just to shut down a potential filibuster and move the CLARITY Act toward an eventual final vote.<\/p>\n<p>\u201cAfter a year of intense daily bipartisan negotiations, this bill is ready,\u201d U.S. Senator <a href=\"https:\/\/www.lummis.senate.gov\/press-releases\/lummis-boozman-scott-release-final-clarity-act-text\/\" target=\"_blank\" rel=\"noopener noreferrer\">Cynthia Lummis (R-WY) wrote on Monday<\/a>. \u201cPresident Trump voluntarily agreed to unprecedented ethics restrictions, holding every federally elected official, judge, and their spouses to some of the toughest ethics restrictions in U.S. history.\u201d<\/p>\n<h2>First Comes the 60-Vote Wall<\/h2>\n<p>Here\u2019s how this works. Senate rules generally allow debate to continue without a normal hard stop, giving opponents the ability to delay <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/3633\/text\" target=\"_blank\" rel=\"noopener noreferrer\">the legislation<\/a> through a filibuster. Cloture is essentially the Senate\u2019s brake pedal for that process.<\/p>\n<p>At least 16 senators must first sign a cloture motion. Then comes a mandatory waiting period before the chamber can vote on ending debate. When that vote finally arrives, three-fifths of all sworn senators must agree. With 100 senators, that means 60 votes.<\/p>\n<p>That is the hurdle <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/clarity-act-odds-slide-to-18-as-banks-and-state-ags-push-back\/\">facing the CLARITY Act<\/a> today.<\/p>\n<h2>Then the Senate Can Actually Vote<\/h2>\n<p>If cloture receives 60 votes, the bill doesn\u2019t suddenly become law. It doesn\u2019t even mean the Senate has passed it.<\/p>\n<p>Instead, debate becomes limited, with the supplied Senate process allowing up to 30 additional hours before the chamber proceeds toward a final vote. That later vote normally needs only a simple majority. Put another way, getting from 59 cloture votes to 60 can be considerably harder than getting from 50 votes to 51 when the bill itself finally comes up.<\/p>\n<p>If cloture fails, the filibuster remains standing. Debate can continue, and sponsors commonly pull legislation when it becomes clear they cannot break the blockade.<\/p>\n<h2>Prediction Markets See Two Different Battles<\/h2>\n<p><a href=\"https:\/\/www.bitcoin.com\/get-started\/defi-and-web3\/prediction-markets\/what-are-prediction-markets\/\" target=\"_blank\" rel=\"noopener noreferrer\">Prediction marketplace traders<\/a> see an interesting distinction between getting a Senate vote and actually turning crypto market structure legislation into law.<\/p>\n<p>Kalshi bettors <a href=\"https:\/\/kalshi.com\/markets\/kxclarityvote\/will-the-senate-vote-on-the-clarity-act\/kxclarityvote-26jul\" target=\"_blank\" rel=\"noopener noreferrer\">put a 93% implied probability<\/a> on the Senate holding a recorded CLARITY Act-related vote before Oct. 1, with more than $1.3 million traded. Yet another Kalshi market gives qualifying crypto market structure legislation <a href=\"https:\/\/kalshi.com\/markets\/kxcryptostructure\/crypto-market-structure\/kxcryptostructure-26jan\" target=\"_blank\" rel=\"noopener noreferrer\">only a 39% probability<\/a> of becoming law before July 1, 2027.
