Then the door stayed shut. <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/clarity-act-made-126-concessions-and-still-couldnt-get-60-votes\/\">The 49-50 cloture vote<\/a> wasn\u2019t a vote on whether H.R. 3633 should become law. It was a vote on whether senators should begin debating it at all.<\/p>\n<p>Sixty votes were required. Without them, debate doesn\u2019t begin, amendments don\u2019t start flying, and there\u2019s no final-passage vote waiting around the corner. The House had already passed its version 294-134 in July 2025, while the Senate Banking Committee advanced the legislation 15-9 in May.<\/p>\n<p>Democrats were not having it. The legislation remains Calendar No. 423, meaning <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/thune-to-file-motion-to-force-september-vote-on-clarity-act\/\">Senate Majority Leader John Thune<\/a> can try again. He can file another cloture motion on the motion to proceed if supporters find additional votes, or pursue reconsideration of Tuesday\u2019s failed vote. That\u2019s the procedural route. The political route is considerably messier.<\/p>\n<figure id=\"attachment_847985\" aria-describedby=\"caption-attachment-847985\" style=\"width:2014px\" class=\"wp-caption aligncenter\"><figcaption id=\"caption-attachment-847985\" class=\"wp-caption-text\">Senators who voted against advancing the Crypto Clarity Act included independents Angus King and Bernie Sanders; Republicans Thom Tillis, Jerry Moran, Josh Hawley, and Susan Collins; and Democrats Andy Kim, Tim Kaine, Jack Reed, Mark Kelly, Ed Markey, Tina Smith, Jon Ossoff, Alex Padilla, Ron Wyden, Dick Durbin, Gary Peters, Peter Welch, Jeff Merkley, Cory Booker, Jacky Rosen, Adam Schiff, Brian Schatz, Patty Murray, Mark Warner, Elissa Slotkin, Mazie Hirono, Chris Murphy, Ben Ray Luj\u00e1n, Ruben Gallego, Maria Cantwell, Maggie Hassan, Amy Klobuchar, Martin Heinrich, John Fetterman, Tammy Baldwin, Michael Bennet, Chuck Schumer, Jeanne Shaheen, Chris Van Hollen, Elizabeth Warren, Kirsten Gillibrand, Raphael Warnock, John Hickenlooper, Tammy Duckworth, Richard Blumenthal, Lisa Blunt Rochester, Sheldon Whitehouse, and Catherine Cortez Masto.<\/figcaption><\/figure>\n<p>Every Democrat opposed advancement on Tuesday, while Republicans Susan Collins, Josh Hawley, and Jerry Moran also voted against cloture. Even another successful cloture attempt would only open the next stage. Senators would still have to debate the motion to proceed, get onto the legislation itself, deal with amendments and eventually clear another procedural hurdle before final passage. Sponsors would need to reintroduce market-structure legislation, move it through committees again and rebuild a Senate coalition capable of reaching the required threshold.<\/p>\n<p>Meanwhile, the SEC and CFTC <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/sec-cftc-forge-their-own-crypto-paths-as-clarity-act-stalls-out\/\">continue operating under existing law<\/a> and pursuing their own crypto rulemaking agendas.
