Moreover, options activity also jumped 350%, briefly overtaking both bitcoin and ether.<\/p>\n<p>Amidst all of these developments, Ripple\u2019s argument was a little confounding, not engaging with the price dip at all. Instead, the firm\u2019s chief legal officer <a href=\"https:\/\/x.com\/s_alderoty\/status\/2099944087470145631\" target=\"_blank\" rel=\"noopener noreferrer\">Stuart Alderoty opined<\/a>:<\/p>\n<blockquote>\n<p>Ripple and XRP stand on settled ground.<\/p>\n<\/blockquote>\n<p>His case rested on two points:<\/p>\n<ul>\n<li>The first is the 2023 federal court ruling that programmatic XRP sales on exchanges were not securities transactions.<\/li>\n<li>The second is more recent and more consequential. On March 17, the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) issued a <a href=\"https:\/\/www.sec.gov\/files\/rules\/interp\/2026\/33-11412.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">joint interpretive release<\/a> naming 18 crypto assets as digital commodities rather than securities, XRP among them alongside BTC, ETH and SOL. Unlike staff speeches, that interpretation is a formal agency action <a href=\"https:\/\/www.jenner.com\/en\/news-insights\/client-alerts\/sec-and-cftc-issue-landmark-joint-interpretation-on-crypto-asset-classification\" target=\"_blank\" rel=\"noopener noreferrer\">binding on both regulators<\/a>.<\/li>\n<\/ul>\n<p>Lastly, Ripple\u2019s corporate account called the failed vote \u201c<a href=\"https:\/\/twitter.com\/Ripple\/status\/2099970313622544397\" target=\"_blank\" rel=\"noopener noreferrer\">a tremendous missed opportunity<\/a>\u201d while making the same point as its CLO, i.e. the need for clear rules has not gone away, and neither has the company\u2019s role in writing them.<\/p>\n<h2>Decoding XRP Fall and the Road Ahead<\/h2>\n<p>When one asset absorbs the most leveraged upside bets ahead of a binary event, it accrues the most forced selling when the event goes the wrong way. Bitcoin\u2019s price fell under $75,000 for the first time since Aug. 20 in the same window, but from a base of far less concentrated speculation.<\/p>\n<p>Also, it bears mentioning that SEC Chairman Paul Atkins and CFTC Chairman Michael Selig launched <a href=\"https:\/\/www.nortonrosefulbright.com\/en\/knowledge\/publications\/a88b661b\/sec-and-cftc-release-joint-interpretation-on-crypto-asset-regulation\" target=\"_blank\" rel=\"noopener noreferrer\">Project Crypto as a joint effort<\/a> in January to harmonize oversight, and the March interpretation was its first major output. Former CFTC chairman Christopher <a href=\"https:\/\/twitter.com\/EleanorTerrett\/status\/2100041480559550955\" target=\"_blank\" rel=\"noopener noreferrer\">Giancarlo said after the vote<\/a> that the two chairs are determined to put frameworks in place under U.S. law rather than watch activity move offshore.<\/p>\n<p>For XRP, that is a slower path with a lower ceiling.
