The European Commission\u2019s MiCA consultation closed Sept. 30 and could inform future legislative changes.<\/p>\n<h2>Europe Considers Suitability Tests and DeFi Certification<\/h2>\n<p>Kulechov\u2019s criticism reflects proposals actually under consideration.<\/p>\n<p>The EBA has recommended <a href=\"https:\/\/eba.europa.eu\/sites\/default\/files\/2026-09\/12cb4f01-0d51-46bf-a561-165ac486698f\/EBA%20response%20to%20EC%20targeted%20consultation%20on%20MiCA%20review.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">studying rules for crypto firms<\/a> that facilitate access to DeFi lending. Potential measures include suitability tests, leverage limits, additional disclosures and even certification of DeFi lending protocols. It also raised the possibility of restricting access to lending involving stablecoins that lack required MiCA authorization.<\/p>\n<p>The European System of Central Banks, which includes the ECB, has meanwhile argued that restrictions on stablecoin remuneration should cover indirect returns generated through lending, borrowing and staking.<\/p>\n<p>Kulechov argues such measures could fragment liquidity and create regulated gateways around networks designed to remain permissionless.<\/p>\n<h2>Morpho Shares Concerns Over DeFi Restrictions<\/h2>\n<p>Morpho has taken a similar, though more qualified, position.<\/p>\n<p>Morpho Global Head of Policy Affairs <a href=\"https:\/\/x.com\/faufleuret\/status\/2105701916420502011?s=20\" target=\"_blank\" rel=\"noopener noreferrer\">Faustine Fleuret said the protocol<\/a> welcomed the principle that regulatory obligations should focus on identifiable actors and access points rather than decentralized code itself.<\/p>\n<p>But it opposed extending stablecoin remuneration restrictions to <a href=\"https:\/\/news.bitcoin.com\/crypto-news\/hyperliquid-aqav2-hype-buyback-usdc\/\">DeFi yield<\/a>, mandatory protocol certification and the creation of a separate MiCA service specifically for DeFi access.<\/p>\n<p>The broader regulatory debate is becoming increasingly consequential as lending, stablecoins, and <a href=\"https:\/\/news.bitcoin.com\/defi\/tokenized-stocks-hit-3-6b-avalanche-solana-split-market\/\">tokenized securities<\/a> migrate onchain.<\/p>\n<h2>Circle and Hyperliquid Push Alternative Approaches<\/h2>\n<p>Other major crypto companies are also pressing for changes.<\/p>\n<p>Circle wants Europe to preserve multi-issuance structures for <a href=\"https:\/\/news.bitcoin.com\/stablecoins\/tether-co-founder-says-stablecoin-2-0-will-put-reserves-onchain\/\">global stablecoins<\/a> and reconsider rigid bank-deposit requirements for reserves.<\/p>\n<p>The Hyperliquid Policy Center has argued that perpetual futures should remain within existing MiFID II derivatives rules rather than trigger an entirely new regulatory framework.<\/p>\n<p>The fight is therefore no longer about whether Europe regulates crypto, as MiCA already does that. The question is whether its next iteration allows open DeFi to connect with regulated finance, or pushes European users toward a narrower collection of approved gateways.<\/p>\n<p>Kulechov\u2019s
