We need that permanent law change to make sure America is number one in digital assets and blockchain technology,\u201d Hill declared <a href=\"https:\/\/www.foxbusiness.com\/video\/6406418287112\" target=\"_blank\" rel=\"noopener noreferrer\">during an interview on Fox Business<\/a> aired on Wednesday.<\/p>\n<p>Hill, who <a href=\"https:\/\/news.bitcoin.com\/us-regulatory-clarity-for-crypto-landmark-legislation-fit21-act-heads-to-house-vote\/\">championed the Financial Innovation and Technology for the 21st Century Act (FIT 21)<\/a>, an earlier attempt to regulate the digital assets industry, also commented on the recent regulatory escalation from government agencies like the <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/sec-proposes-letting-advisers-and-funds-self-custody-crypto-assets\/\">Securities and Exchange Commission<\/a> (SEC) and the <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/cftc-opens-crypto-rulebook-selig-tells-industry-build-here\/\">Commodity Futures Trading Commission<\/a> (CFTC).<\/p>\n<p>Hill recognized that the SEC and the CFTC were using their existing regulatory faculties to define digital assets and digital commodities so the crypto system can function. Nonetheless, he stressed that this approach was insufficient.<\/p>\n<p>\u201cIn my judgment, these regulatory policies fall short of what we have to do, which is have a legislative solution,\u201d Hill concluded.<\/p>\n<p>While helpful, analysts have stressed that agency rules can change and be reversed more easily than congressional action. After CLARITY fell short, Troutman Pepper Locke highlighted that while agency-based rules offer guidance, they cannot give certainty.<\/p>\n<p>\u201cAgency action is subject to direction under future administrations, which could revise or withdraw rules and interpretations and change agency enforcement priorities,\u201d <a href=\"https:\/\/www.troutman.com\/insights\/in-the-wake-of-clarity-acts-failure-agencies-move-forward-without-congressional-action-or-certainty\/\" target=\"_blank\" rel=\"noopener noreferrer\">the firm declared<\/a>, pointing to the Trump administration\u2019s reversal of years of anti-crypto policies and enforcement actions against crypto industry actors as an example.<\/p>\n<p>Agency action can also be contested. In fact, John Reed Stark, founder and former chief of the SEC\u2019s Office of Internet Enforcement, has already labeled the SEC\u2019s deregulation push as overreach, stressing that these matters <a href=\"https:\/\/news.bitcoin.com\/regulation-and-legal\/ex-sec-chief-claims-agency-overreaches-authority-on-crypto-rules\/\">exceed the agency\u2019s faculties<\/a> and usurp congressional
