In <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/26-299.html\" target=\"_blank\" rel=\"noopener noreferrer\">Flaherty v. KalshiEX<\/a>, the International Association of Gaming Regulators (IAGR), which represents regulators \u201cworldwide,\u201d and the North American Gaming Regulators Association (NAGRA) filed a joint brief on Oct. 2. Ohio, along with 38 other states and the District of Columbia, followed on Oct. 7, and the NFL filed on Oct. 8.<\/p>\n<p>All of the briefs ask the justices to decide whether federal commodities law shields sports event contracts on CFTC-registered exchanges from state gambling laws. The Third Circuit sided with Kalshi in New Jersey in April, while the Ninth and Sixth Circuits <a href=\"https:\/\/news.bitcoin.com\/igaming\/sixth-circuit-turns-kalshis-own-words-against-two-state-loss\/\">ruled against the company<\/a>. Its response to the petition is due Nov. 9.<\/p>\n<p>\u201cThe same product, offered by the same company under the same federal registration, is presently shielded from state regulatory authority within the Third Circuit and subject to it within the Sixth and Ninth,\u201d <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-299\/428370\/20261002172612208_397111_Brief%20of%20Amici.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the regulators wrote<\/a>. NAGRA\u2019s members include tribal and Canadian provincial regulators, and the brief leans on a September Ninth Circuit ruling for California tribes: \u201cKalshi may reshuffle the cards, but it cannot change the hand: Its sports event contracts are class III gaming.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-299\/428759\/20261007134816267_Kalshi%20Cert%20Amicus.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">states\u2019 brief<\/a>, led by Ohio, calls federal and state courts \u201chopelessly confused and divided,\u201d and says prediction markets \u201ccannot strip the states of their core sovereign power through relabeling and window-dressing.\u201d Its signers include Alabama, California, Michigan, Nevada, New York, and Pennsylvania. Texas and Florida did not sign. The brief also counts nine states the CFTC itself has sued to block enforcement.<\/p>\n<p>The <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-299\/428826\/20261008053543625_NFL%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">NFL\u2019s brief<\/a>, whose counsel includes former U.S. Attorney General William Barr, says $1.8 billion of the $3.3 billion traded on prediction markets on the season\u2019s first Sunday was tied to NFL games. The American football league says the CFTC and exchanges such as Kalshi have declined its requests to ban bets \u201ceasily manipulable by a single person\u201d and to set a minimum age of 21, leaving 18-year-olds able to trade. It asks the court to act \u201cbefore another NFL season goes by.\u201d<\/p>\n<p>The lower courts are not unanimous: a federal judge in Chicago <a href=\"https:\/\/news.bitcoin.com\/igaming\/kalshi-ends-federal-court-losing-streak-partial-win-over-illinois\/\">granted Kalshi a partial win over Illinois<\/a> on Oct. 2, the same day the regulators filed.<\/p>\n<p>The case also turns on the words of a former lawmaker who is now paid by Kalshi. New Jersey\u2019s petition cites 2010 Senate remarks by then-Sen. Blanche Lincoln of Arkansas, and the Third Circuit dissent quotes her warning that \u201cit would be quite easy to construct an \u2018event contract\u2019 around sporting events such as the Super Bowl,\u201d contracts that \u201cwould be used solely for gambling.\u201d<\/p>\n<p>Lincoln Policy Group, which lists Lincoln as a lobbyist, has reported $480,000 in lobbying income from Kalshi since 2024, according to <a href=\"https:\/\/lda.gov\/filings\/public\/filing\/search\/\" target=\"_blank\" rel=\"noopener noreferrer\">federal lobbying disclosures<\/a>. She also joined other former lawmakers in a brief supporting Kalshi at the Third Circuit.<\/p>\n<p>On Polymarket, the chance that the court accepts a sports event contract case by Oct. 31 <a href=\"https:\/\/polymarket.com\/event\/scotus-accepts-sports-event-contract-case-by-july-31-2026\" target=\"_blank\" rel=\"noopener noreferrer\">stood at 3% on Thursday<\/a>, and 28% by Dec. 31, though only about $24,000 has traded on the year-end contract. Kalshi\u2019s <a href=\"https:\/\/news.bitcoin.com\/igaming\/kalshis-scotus-pregame-wait-for-the-cftc-to-rewrite-the-rules\/\">Supreme Court strategy<\/a> has leaned on a pending CFTC rewrite of its
