On Oct. 12, 2026, Britain’s High Court ruled that Chinese law, rather than English law, must govern their claims to the cryptocurrency, now valued at approximately $5 billion.

The decision hands U.K. prosecutors an important legal victory, although the government hasn’t secured an outright claim to the fortune. For investors who lost money nearly a decade ago, the ruling complicates an already extraordinary fight over who gets the large cache of bitcoin.

A $5 Billion Bitcoin Fortune With a Troubled Past

The extraordinary case traces back to Zhimin Qian, also known as Yadi Zhang, who orchestrated approximately 10 fraudulent investment schemes in China between 2014 and 2017. Operating through Tianjin Lantian Gerui Electronic Technology Co. Ltd. and related entities, Qian collected approximately 40.2 billion yuan, equivalent to roughly £4.1 billion, from investors. Court records identify at least 128,409 investment contracts, although the precise number of individual victims remains uncertain.

Zhimin Qian – Image Source: Reuters.

The operation returned approximately 34.1 billion yuan to some investors, leaving others holding substantial losses. Qian converted portions of the proceeds into bitcoin (BTC), purchasing more than 100,000 BTC through an exchange account she controlled before fleeing China in July 2017. She subsequently entered Britain under an assumed identity, where authorities eventually uncovered one of the largest cryptocurrency seizures in law enforcement history.

London Police Uncover a Bitcoin Treasure Trove

Metropolitan Police officers searched properties connected to Qian and associate Jian Wen on Oct. 31 and Nov. 1, 2018. Investigators confiscated electronic devices, wallet credentials, and other assets connected to more than 61,000 BTC. The cryptocurrency’s subsequent appreciation transformed an already enormous criminal investigation into a multibillion-dollar ownership battle.

The U.K. government’s stash of 61,245.01 BTC is tracked by Arkham Intelligence.

Qian was eventually arrested in April 2024 and pleaded guilty to money laundering offenses in September 2025. She received an 11-year, eight-month prison sentence last November. Meanwhile, thousands of investors pursued claims under Section 281 of Britain’s Proceeds of Crime Act 2002, arguing that portions of the recovered bitcoin legally belonged to them.

The question was whether victims could establish ownership rights over cryptocurrency purchased with their stolen money, rather than merely demonstrating that they were owed compensation.

High Court Nixes English Law Argument

In the Director of Public Prosecutions v Zhimin Qian court filing, published earlier this week, Justice Mark Turner rejected arguments that English law, or a combination of English and Chinese law, should determine those underlying ownership rights. The judge concluded that the fraudulent investments, financial losses, and bitcoin acquisitions were fundamentally connected to China.

Turner’s decision also rejected attempts to use English legal principles to establish ownership rights that might not exist under the applicable Chinese law.

The judgment states:

“The applicable law is Chinese law.”

That finding deals a blow to investors hoping to use English legal protections to establish direct ownership of the seized cryptocurrency. However, the court did not determine whether Chinese law ultimately recognizes their claims.

Who Gets the Bitcoin? The Fight Isn’t Finished

The ruling strengthens the position of Britain’s Director of Public Prosecutions, which is pursuing civil recovery of the assets, but it doesn’t establish that the Treasury can keep the proceeds. Turner emphasized that questions concerning the substance and application of Chinese law must be resolved during subsequent proceedings.

That leaves the government, the fraud victims, and other interested parties facing another round of legal arguments over an extraordinary bitcoin fortune.

The criminal case has already put Qian behind bars. Nearly nine years after she fled China, however, the considerably more expensive question of who owns her seized bitcoin remains unanswered.

<div
